CIVIL JUDGMENT

Below is a brief description of the content of Judgment No. 556/04 of the Court of First Instance and Instruction No. 2 of Utrera, where the plaintiff demanded from the Public Prosecutor the rectification of his birth registration due to a change of sex and name.

Once the claim was admitted, it was stated that the plaintiff was currently registered as a male in the civil registry after his birth. However, she declares that she feels and behaves like a woman since her childhood. On November 28, 2003, she underwent a sex change operation, after a large number of tests and psychological follow-up. The plaintiff presented external primary and secondary sexual characteristics typical of the female sex, undergoing a total transformation of her sexual morphology with the assumption of a feminine sexual and emotional role. All this was accredited by the testimonial evidence verified in plenary.

The ruling finally upheld the claim in favor of the plaintiff who currently has the female name, rectifying a substitution of sex and name in the birth registration.
